Access to genetic resources


The general objective of the project is to present a Policy on Access to genetic resources and the different possible alternatives to the Ministry of the Environment. This project has the following specific objectives:
  1. To identify the mechanisms of protection of traditional knowledge and the existing legal alternatives.
  2. To analyze relevant scientific and technological aspects such as the national availability of human resources trained for projects on access to genetic resources; national technological offer for projects on access to genetic resources; national biological offer in species, with the existing information on natural history, geographic location, genetic information and recognized uses of the resources; availability of knowledge, which should include traditional knowledge linked to item number one, coupled with information on the location of local communities and the types of resources and knowledge referred to in the literature; and analysis of the possible environmental impact of different types of activities of access to genetic resources.
  3. To analyze relevant legal aspects such as: content of the different types of contracts established in decision 391; to develop a sanction and infraction regime; to develop a legal proposal for permits associated with access activities, given the Colombian legislation and decision 391; to analyze the current national and international regime of intellectual property rights and to identify the need to adapt these and the strategies of international negotiation with the CDB and in the World Commerce Organization.
  4. To analyze relevant economic aspects such as: analysis of the International market of natural products for activities of access to genetic resources, with emphasis on demand; analysis of the Colombian conditions which affect different types of activities of development linked to access to genetic resources; to identify the real possibilities for Colombia to rise in the chain of aggregate value (information), taking into account the international and national markets, the biological offer, the human and technological resources offered and the available information; to determine the economic negotiating strategy alternatives, including the determination of the access prices for different activities (Pharmaceuticals, Biopesticides, Biomaterials, etc.) and the different steps of research in genetic resources. The strategy should take into account the abovementioned aspects; to identify the types "packages of access to resources" which Colombia could offer and to analyze the types of offer using the market information and biological offer available.
  5. To have access to current information on the topic mainly in the countries belonging to the Andean Group and Brazil.
  6. To develop a proposal of just and equitable distribution of the benefits derived from access to genetic resources, taking into account the identified strategies. To analyze the relevant institutional aspects.
